This page features Frequently Asked Questions and Answers as well questions submitted by New Paltz community members.<\/p>\n<p>&nbsp;<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_text_2 et_pb_text et_pb_bg_layout_light et_pb_module et_block_module\"><div class=\"et_pb_text_inner\"><h2>Consolidation Frequently Asked Questions (FAQ's)<\/h2>\n<p>&nbsp;<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_toggle_0 et_pb_toggle et_pb_toggle_item et_pb_toggle_close et_clickable et_pb_module et_block_module\"><h5 class=\"et_pb_toggle_title\">FAQ A: What is a Consolidation Agreement?<\/h5><div class=\"et_pb_toggle_content clearfix\"><p>Pursuant to General Municipal Law Article 17-A, the Town and Village of New Paltz are authorized to undertake a joint board initiated process to explore the consolidation of the Town of New Paltz and the Village of New Paltz. This includes development of a consolidation agreement to assist the citizens of the Town and Village of New Paltz in understanding the logistics and making an informed decision should the Village Board choose to move this forward to a referendum vote.<\/p>\n<p><strong>\u00a0<\/strong><strong>Process:<br \/><\/strong>The Town and Village will be hosting a series of public information meetings and conversations, and will be providing a series of informational releases to keep constituents informed on both the process and the impacts of consolidation. Public engagement will continue until the date of the referendum.<\/p>\n<p>Upon endorsement by both the Town Board and the Village Board of Trustees on the Proposed Joint Consolidation Agreement, the Town and Village will host a public hearing the New Paltz Central School District Middle School<strong>, <\/strong>196 Main St, New Paltz, NY 12561 on Tuesday, July 7th at 6:00pm.<\/p>\n<p>Based on citizen input, the Town and Village Boards may amend the Proposed Joint Consolidation Agreement and adopt a Final Proposed Joint Consolidation Agreement.\u00a0 Simultaneously, with the final approval of the Agreement, the Village and Town boards\u00a0 shall set the date for the referendum.<\/p>\n<p>\u00a0At this point, the Village and Town Boards can revise or finalize the joint consolidation agreement or decline to proceed further with consolidation proceedings<\/p>\n<p>If moving forward, a final Consolidation Agreement will be approved, and a referendum date will be scheduled within 60 to 90 days of the joint agreement approval. The referendum is a vote by a majority of electors of the Town and Village, voting in favor of, or in opposition to a municipal consolidation.<\/p>\n<p>A copy of the amended version of the proposed joint consolidation agreement will be displayed and readily accessible to the public for inspection in both the village and town halls, as well as the project website at www.labergegroup.com\/newpaltz prior to the referendum date.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_toggle_1 et_pb_toggle et_pb_toggle_item et_pb_toggle_close et_clickable et_pb_module et_block_module\"><h5 class=\"et_pb_toggle_title\">FAQ B: Will there be additional public meetings?<\/h5><div class=\"et_pb_toggle_content clearfix\"><p>Yes. There have been a number of Village Dissolutions. For village residents, what changes will be noticeable should the Village vote to dissolve?<\/h5><div class=\"et_pb_toggle_content clearfix\"><p>It is important to know that the impacts of dissolution are very different community to community and require customized research and analysis reflective each community. \u00a0The research, analysis, and Dissolution Plan development has just begun in New Paltz.\u00a0 Currently, we are in the data gathering phase.<\/p>\n<p>We suggest that you check back closer to the second public information meeting for a more in depth response to your question. In general, village dissolution ends the village government transfers the delivery of services and governance to the Town Board. As such, all services currently provided by the Village will be provided by the Town of New Paltz. Governance would be provided by the Town Board; water, sewer, road maintenance and parks\/recreation will be provided by Town staff; planning and zoning would be overseen by the Town Planning Board and Zoning Board of Appeals, etc. Fire services will still be provided, but the form of that service is still to be decided.\u00a0 Public Safety and Justice Court services will continue to be provided townwide.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_toggle_15 et_pb_toggle et_pb_toggle_item et_pb_toggle_close et_pb_module et_block_module\"><h5 class=\"et_pb_toggle_title\">6. In so far as zoning is concerned, upon dissolution, the Village Zoning Code stays in effect for up to two (2) years or until such time as it is repealed, replaced, or meshed into the Town Zoning Code\u00a0\u2013 whichever comes sooner. Upon dissolution, the Town Planning Board will be the entity overseeing land use and site plan approval in accordance with both the Village Zoning Code and then the new Town Zoning Code.\u00a0 The dissolution planning process, which has just begun, will outline options related to land use planning and may result in the identification of a potential preferred approach towards Village zoning post a possible dissolution.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_toggle_16 et_pb_toggle et_pb_toggle_item et_pb_toggle_close et_pb_module et_block_module\"><h5 class=\"et_pb_toggle_title\">\u00a07. For specific amount please contact the Department of State at 518-473-3355.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_toggle_32 et_pb_toggle et_pb_toggle_item et_pb_toggle_close et_pb_module et_block_module\"><h5 class=\"et_pb_toggle_title\">24. Is creating special districts included in the Village wide referendum or do they require a separate referendum? One of the pitfalls of dissolution is that it requires the creation of these special districts to be subject to a permissive referendum. However, most of these times these special districts are for services and debt already incurred in the former village (water and sewer for example). The law does not exempt these special districts from a possible permissive referendum, creating a possibility that the electorate may choose to vote down a district that already \u201cexisted\u201d prior to dissolution<\/h5><div class=\"et_pb_toggle_content clearfix\"><p>The creation of a special district that is the same boundary as the existing village service area is not subject to permissive referendum. By virtue of voting to dissolve, the voters are also voting to create the special improvement district for the current boundary. Should the boundary be proposed to be enlarged or changed, then it would be subject to a permissive referendum.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_toggle_33 et_pb_toggle et_pb_toggle_item et_pb_toggle_close et_pb_module et_block_module\"><h5 class=\"et_pb_toggle_title\">25. (3\/21\/25) Does the Village have plans to address routine upkeep and maintenance to the Village Hall such as repairing roof leaks, repairing solar panel systems, repairing the EV charger, repairing the elevator or making the Village Hall ADA compliant again before the dissolution vote?<\/h5><div class=\"et_pb_toggle_content clearfix\"><p>Current and planned maintenance to the Village Hall is not a part of the Dissolution Planning process. Please contact the Village Board for an update on any planned maintenance or improvements.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_toggle_34 et_pb_toggle et_pb_toggle_item et_pb_toggle_close et_pb_module et_block_module\"><h5 class=\"et_pb_toggle_title\">\u00a026. (3\/21\/25) Village Board members have stated that as part of the dissolution plan, Village assets would be sold to satisfy village debt. Would the Village sell all Village assets including highway equipment and\/or equipment used to manage village services?<\/h5><div class=\"et_pb_toggle_content clearfix\"><p>In short, should the Village voters elect to dissolve the Village, the Village Board of Trustees has the right to sell and liquidate its assets and\/or transfer its assets to other parties for public purposes.\u00a0Any remaining assets at the time of dissolution are transferred to the Town. Article 17-A requires the development of a plan for the disposition of Village assets. When completed, a copy of the Dissolution Plan will be available for public review.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_toggle_35 et_pb_toggle et_pb_toggle_item et_pb_toggle_close et_pb_module et_block_module\"><h5 class=\"et_pb_toggle_title\">27. (3\/31\/25) What happens if the Village debt cannot be fully satisfied at the time of dissolution? Would the town bear any liability for the debt, and if so, would town resident taxpayers be on the hook to satisfy the village debt? Would the resident taxpayers living in the former village be on the hook to satisfy the debt? Will the amount of debt be disclosed prior to dissolution? What about Village contractual debt, such as lifelong health care premiums for village employees and their families?<\/h5><div class=\"et_pb_toggle_content clearfix\"><p>As part of the development of a Dissolution plan under Article 17-A, the plan will document the current Village assets and liabilities. Any outstanding general liabilities including contractual liabilities (i.e. retiree health care) will be borne by the former Village property owners. As mandated by Article 17-A, the Plan will include the following information:<\/p>\n<ol>\n<li>The name of the local government entity to be dissolved.<\/li>\n<li>The territorial boundaries of the entity.<\/li>\n<li>The type and\/or class of the entity.<\/li>\n<li>A fiscal estimate of the cost of dissolution.<\/li>\n<li>The entity\u2019s assets, including but not limited to real and personal property, and the fair value thereof in current money of the United States.<\/li>\n<li>Any plan for the transfer or elimination of public employees.<\/li>\n<li>The entity\u2019s liabilities and indebtedness, bonded and otherwise, and the fair value thereof in current money of the United States.<\/li>\n<li>Any agreements entered into with the Town in which the entity is situated in order to carry out the dissolution.<\/li>\n<li>The manner and means by which the residents of the entity will continue to be furnished municipal services following the entity\u2019s dissolution.<\/li>\n<li>Terms for the disposition of the entity\u2019s assets and the disposition of its liabilities and indebtedness, including the levy and collection of the necessary taxes and assessments therefore.<\/li>\n<li>Findings as to whether any local laws, ordinances, rules or regulations of the entity shall remain in effect after the effective date of the dissolution or shall remain in effect for a period of time other than as provided by GML Article 17-A \u00a7789.<\/li>\n<li>The effective date of the dissolution.<\/li>\n<li>The time and place or places for a public hearing or hearings on the proposed dissolution plan.<\/li>\n<li>Any other matter desirable or necessary to carry out the dissolution.<\/li>\n<\/ol>\n<p>The\u00a0<em>Village Dissolution Plan<\/em>\u00a0will also provide information regarding the probable impact of a potential dissolution on issues ranging from continuity of governance, to tax rates, to service delivery.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_toggle_39 et_pb_toggle et_pb_toggle_item et_pb_toggle_close et_pb_module et_block_module\"><h5 class=\"et_pb_toggle_title\">FAQ 4. In accordance with Article 17-A, the Village Board must accept by resolution the Village Dissolution Plan in order to further the dissolution process.
