What is a Dissolution Plan?<\/h5><div class=\"et_pb_toggle_content\"><p>General Municipal Law Article 17-A provides a unified process for the dissolution of local government entities. The process is applicable to towns, villages, fire protection districts, and special improvement districts created pursuant to Articles 11, 12, 12-a, or 13 of Town Law, and other districts created by law. Under Article 17-A of General Municipal Law, there are two different methods for local governments to consider: Board-Initiated or Citizen-Initiated.<br \/>\nThe Board of Trustees of the Village of Addison has voted to explore the option of dissolution of the Village government which would result in absorption of governance and services by the Town of Addison. The Board has secured CREG grant funding from the New York State Department of State to produce a Village Dissolution Plan. This Plan will assist the Board and the residents of Addison in understanding the potential impacts of dissolution.<br \/>\nIn addition to this Plan, the Village will host a public information meeting to answer questions regarding the process and potential outcomes as well as a public hearing during which the Draft Plan will be presented.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_1 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_block_module\"><h5 class=\"et_pb_toggle_title\">2 FAQ. Is this a Board-Initiated or Citizen-Initiated Dissolution process?<\/h5><div class=\"et_pb_toggle_content\"><p>This is a Board-Initiated Dissolution process. Does the Village need a Dissolution Plan?<\/h5><div class=\"et_pb_toggle_content\"><p>In accordance with New York General Municipal Law (GML) Article 17-A \u00a7774, the Board of Trustees of the Village is required to prepare a Dissolution Plan under a Board initiated process. As mandated by Article 17-A, the Plan will include the following information:<\/p>\n<ol>\n<li>The name of the local government entity to be dissolved.<\/li>\n<li>The territorial boundaries of the entity.<\/li>\n<li>The type and\/or class of the entity.<\/li>\n<li>A fiscal estimate of the cost of dissolution.<\/li>\n<li>The entity\u2019s assets, including but not limited to real and personal property, and the fair value thereof in current money of the United States.<\/li>\n<li>Any plan for the transfer or elimination of public employees.<\/li>\n<li>The entity\u2019s liabilities and indebtedness, bonded and otherwise, and the fair value thereof in current money of the United States.<\/li>\n<li>Any agreements entered into with the Town in which the entity is situated in order to carry out the dissolution.<\/li>\n<li>The manner and means by which the residents of the entity will continue to be furnished municipal services following the entity\u2019s dissolution.<\/li>\n<li>Terms for the disposition of the entity\u2019s assets and the disposition of its liabilities and indebtedness, including the levy and collection of the necessary taxes and assessments therefore.<\/li>\n<li>Findings as to whether any local laws, ordinances, rules or regulations of the entity shall remain in effect after the effective date of the dissolution or shall remain in effect for a period of time other than as provided by GML Article 17-A \u00a7789.<\/li>\n<li>The effective date of the dissolution.<\/li>\n<li>The time and place or places for a public hearing or hearings on the proposed dissolution plan.<\/li>\n<li>Any other matter desirable or necessary to carry out the dissolution.<\/li>\n<\/ol>\n<p>The\u00a0<em>Village Dissolution Plan<\/em>\u00a0will also provide information regarding the probable impact of a potential dissolution on issues ranging from continuity of governance, to tax rates, to service delivery.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_3 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_block_module\"><h5 class=\"et_pb_toggle_title\">4 FAQ. This is considered a local government decision. Is the Town obligated to govern the Village if the vote is positive? If not, what happens?<\/h5><div class=\"et_pb_toggle_content\"><p>Should the residents of the Village vote to dissolve the Village, there will no longer be a Village government. As such, all services and governance will be provided by the Town.<\/p>\n<p>If the Village does not vote to dissolve, governance and service delivery remain the same as it is today.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_8 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_block_module\"><h5 class=\"et_pb_toggle_title\">9: (10\/31\/25): What is the breakdown of the 190,000 plus for the percentage of tax breaks between residents and the equipment? Is there a tax break for Addison Village?  What would the break be?  What would the breakdown from Village to Town to Borough be?    What would be the process to get a resource officer in the school?<\/h5><div class=\"et_pb_toggle_content\"><p>70% of the CETC must be applied post dissolution to reduce the\u00a0town-wide tax levy.\u00a0 The town has the discretion as to how to use the balance 30% such as purchasing equipment. The town could choose to apply the full 100% CETC to reducing the post dissolution town-wide tax levy.\u00a0 Because we are just beginning the analysis, we have not calculated what a potential town-wide tax levy would be nor the impact on a village property taxpayers and town outside village taxpayers.\u00a0Once the analysis is completed, we can provide an estimated impact on village property taxpayers.<\/p>\n<p>It is too early in the study process to answer your question as to the school resource officer. It\u00a0has to be determined at a later date as it is part of the bigger decision on how law enforcement services will be delivered post dissolution.<\/p>\n<p>We are unclear as your question \u201cWhat would the breakdown from Village to Town to Borough be\u201c? \u00a0However, the final plan will detail what services the Town will provide, what services may be lost, and the cost impact on both the current Village property owners and the current Town property owners.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_9 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_block_module\"><h5 class=\"et_pb_toggle_title\">10: (10\/31\/25): Is the Town legally required to absorb the Village upon its dissolution?<\/h5><div class=\"et_pb_toggle_content\"><p>If the Village residents chose to dissolve, the Town will be the governing entity as there will no longer be a village government after the date of dissolution. Yes, the Town is required to govern the entirety of the area within its boundaries. How the Town chooses to provide services will be up to the Town Board.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_10 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_block_module\"><h5 class=\"et_pb_toggle_title\">11: (11\/7\/25): Why does the Village of Addison what to dissolve?<\/h5><div class=\"et_pb_toggle_content\"><p>The Village of Addison Board of Trustees has not taken a formal position yet on whether or not to dissolve. In response to the notification of the pending submission of a petition to dissolve the Village, the Board of Trustees adopted a resolution to begin Board Initiated Dissolution Process.\u00a0 A board initiative dissolution\u00a0\u00a0process affords the public more time to understand the process, the impact on taxes, and the potential change in both the delivery and level of local services. The process includes the development of a DRAFT Proposed Dissolution Plan which is then followed by a formal public hearing to solicit citizen input.\u00a0 After the public hearing, the Board of Trustees can then amend and adopt a final proposed plan and call for a referendum on the question:\u00a0Should the Village of Addison Dissolve <strong><u>OR<\/u><\/strong> the Board of Trustees may opt to stop the process.\u00a0The Proposed Plan document developed under Article 17-A of the General Municipal Law will provide residents with unbiased information from which each resident can form their own opinion.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_11 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_block_module\"><h5 class=\"et_pb_toggle_title\">12: (11\/7\/25): If the Town takes over, what will happen to the police department? Who will respond to the law enforcement calls?  <\/h5><div class=\"et_pb_toggle_content\"><p>The Village and Town of Addison have not yet discussed law enforcement in a post-dissolution scenario. Please check back at a later date to learn about the impact on law enforcement should the Village residents vote to dissolve.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_12 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_block_module\"><h5 class=\"et_pb_toggle_title\">13: (11\/7\/25): How about fire and ambulance coverage?  Are people aware of the cost for an AMR ambulance to come to one of our Village residents?<\/h5><div class=\"et_pb_toggle_content\"><p>The Village and Town of Addison have not yet discussed fire and ambulance services in a post-dissolution scenario. Please check back at a later date to learn about the impact on law enforcement should the Village residents vote to dissolve.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_13 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_block_module\"><h5 class=\"et_pb_toggle_title\">14: (11\/7\/25): What is the role of the Steering Committee? Will the Steering Committee Meetings be open to the public?  Where will the meetings be held?  Where will the dates\/times for the meetings be posted?<\/h5><div class=\"et_pb_toggle_content\"><p>The Steering Committee has three primary functions \u2013 1) to provide input on the current state of services in the Village and Town, 2) to provide input on the potential post-dissolution service delivery model, 3) to review the Dissolution Plan and forward a final plan to the Village Board for review and endorsement prior to a Public Hearing.<\/p>\n<p>Steering Committee meetings are not intended to be open to the public and will be held via zoom as needed throughout the plan development.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_14 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_block_module\"><h5 class=\"et_pb_toggle_title\">15: (11\/7\/25): Since this process has been going on for a long time statewide, there should be a record of what people think and what happened after dissolution. Can the state show data on how much money was saved by villages that voted for dissolution and, just as important, their satisfaction after?<\/h5><div class=\"et_pb_toggle_content\"><p>We are not aware of any NYS reports that provide the information you have requested. In 2019 Rockefeller Institute of Government authored a policy brief that can be found at <a href=\"https:\/\/rockinst.org\/wp-content\/uploads\/2019\/06\/Dissolving-Village-Government-in-NYS.pdf\">https:\/\/rockinst.org\/wp-content\/uploads\/2019\/06\/Dissolving-Village-Government-in-NYS.pdf<\/a><\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_15 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_flex_module\"><h5 class=\"et_pb_toggle_title\">16. (1\/23\/26) When is the Dissolution Study expected to be completed and presented to the Village of Addison residents?  Should Village officials and Town officials be meeting to discuss a possible Dissolution prior to the completion of the Dissolution Study. Should these discussions be published and open to the public?<\/h5><div class=\"et_pb_toggle_content et_flex_module\"><p>The consultant team expects to have a draft Dissolution Plan completed and presented to the Village Board in spring 2026 with a\u00a0 public hearing to follow.<\/p>\n<p>All documents will be available on this project website.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_16 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_flex_module\"><h5 class=\"et_pb_toggle_title\">17: (2\/17\/26) If dissolution is passed, how will this affect employees in the Village and in the Town?  Will all Village employees lose their jobs?  Will the Town then hire these employees?  What about fire, ambulance and police, if they are paid by the Village?  Will the Town pick up this up?<\/h5><div class=\"et_pb_toggle_content et_flex_module\"><p>The steering committee is currently determining which services will be maintained and which services will no longer be provided by the Town. Please check back later in the process to review the transition plan.<\/p>\n<p>In general, village dissolution ends the village government and transfers the delivery of services and governance to the Town Board. Individual village staff members will be provided the opportunity to apply for new positions that are created by the Town in order to continue to provide services to the former village. Fire and ambulance services are volunteers, and the continuation of police services has not yet been decided.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_17 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_flex_module\"><h5 class=\"et_pb_toggle_title\">18. (3\/31\/26) Is there a plan for Village owned properties that the community regularly uses such as the Cinderella softball field, Community Center, and Youth Center?<\/h5><div class=\"et_pb_toggle_content et_flex_module\"><p>All Village owned properties (except for the Village Hall) will be transferred to the Town. The Village Hall would be sold.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_18 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_flex_module\"><h5 class=\"et_pb_toggle_title\">19. (3\/31\/26) If the Board rejects the plan, is the process finished?  Also, is the Town eligible to pursue the same grants as the Village?<\/h5><div class=\"et_pb_toggle_content et_flex_module\"><p>If the Village Board decides not to move forward with a referendum after the public hearing, the process stops. However, a petition can still force a referendum. If the Village Board accepts the Plan and sets the referendum, and the Village residents vote not to dissolve, then a 4 year moratorium goes into effect and dissolution cannot be brought up during that time period.<\/p>\n<p>We are not quite sure what grants you are requesting information about - dissolution and implementation or general?<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_19 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_flex_module\"><h5 class=\"et_pb_toggle_title\">20. (3\/31\/26) There is currently a water\/sewer project in the works for the Village of Addison. Current plans are to upgrade our existing and failing water system. If the Village is dissolved, will the Town continue the plans to fix the water and sewer infrastructure? <\/h5><div class=\"et_pb_toggle_content et_flex_module\"><p>During preliminary steering committee meetings and interviews, the Town has stated that they will continue to support, operate and maintain the water and sewer infrastructure system. While conversations on the status of the system(s) have not been part of the scope of this project, substantive discussions would be part of the transition process.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_20 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_flex_module\"><h5 class=\"et_pb_toggle_title\">21. (4\/3\/26) How many registered voters signed the petition to start this dissolution process?<\/h5><div class=\"et_pb_toggle_content et_flex_module\"><p>It is our understanding that the petition had enough signatures to be certified and begin the Citizen\u2019s Initiated Dissolution process. As a result, the Village Board decided to undertake a Board Initiated Dissolution Process under Article 17-A of the GML in order to provide residents the opportunity to take their time and fully understand the impacts prior to a potential vote.<\/p>\n<p>This is a Board-Initiated Dissolution process, not a citizen-initiated process. The Village of Addison Board of Trustees voted to explore the option of dissolution of the Village government, which would result in absorption of governance and services by the Town of Addison. The development of a Village Dissolution Plan will provide information regarding the probable impact of a potential dissolution on issues ranging from continuity of governance, to tax rates, to service delivery. (4\/17\/26) Once the special districts for services and prior debt are determined, how will they be reflected?<\/h5><div class=\"et_pb_toggle_content et_flex_module\"><p>Water, sewer, and lighting districts will be assessed as an ad valorem tax on the new annual tax bill. Water and sewer usage fees will be billed separately.<\/p>\n<\/div><\/div>\n\n<div class=\"et_pb_accordion_item_22 et_pb_accordion_item et_pb_toggle et_pb_module et_pb_toggle_close et_flex_module\"><h5 class=\"et_pb_toggle_title\">23. (4\/17\/26) Services received now are village taxes. What would the services be called after dissolution?<\/h5><div class=\"et_pb_toggle_content et_flex_module\"><p>Following dissolution, the Town will provide these services. Water, sewer, and lighting districts will be assessed as an ad valorem tax on that bill.
