  1. What is a Dissolution Plan?

General Municipal Law Article 17-A provides a unified process for the consolidation and dissolution of local government entities. The process is applicable to towns, villages, fire protection districts, special improvement districts, other improvement districts created pursuant to Articles 11, 12, 12-a or 13 of Town Law, and other districts created by law. Under Article 17-A of General Municipal Law there are two different methods for local governments to consider: Board-Initiated or Citizen-Initiated. The process for either consolidation or dissolution is the same.

The Dissolution Plan is required to evaluate the existing services and generate a proposed Dissolution Plan for review by the governing bodies for adoption.top

  1. Is this a Board-Initiated or Citizen-Initiated Dissolution process?

This is a Citizen-Initiated Dissolution process. On March 11, 2015 the electorate of the Village of Macedon submitted a petition for dissolution in accordance with the Article 17-A of General Municipal Law. The petition contained 111 valid signatures, over 11% of the registered voters (10% are required). The Village Board of Trustees passed a resolution calling for a referendum on the proposed dissolution by the electors on March 25, 2015.top

  1. Why does Macedon need a Dissolution Plan?

The Village of Macedon residents voted on June 10, 2015 to dissolve the Village through a Citizen-Initiated dissolution petition. The vote was 305 to 250. As a result the Village of Macedon is required to prepare and adopt a Dissolution Plan.top

  1. What is the next step after the referendum?

The Village Board was required to meet within 30 days following the referendum vote. The Village Board met on July 8, 2015 and appointed a Steering Committee to develop the Dissolution Plan. The Village Board has 180 days from July 8, 2015 to accept the Dissolution Plan and set a future public hearing.top

  1. Will there be a public hearing?

Yes. The Village Board will review the proposed Dissolution Plan prepared by the Steering Committee. Once the proposed Dissolution Plan is complete to the Village Board’s satisfaction, the Village Board will endorse the Dissolution Plan and set a public hearing for the Village residents to review and comment on the proposed Dissolution Plan. The public hearing will be within 35 to 90 days from the time the Village Board endorses the Plan as complete to allow for adequate public review.

Following the public hearing, the Village Board will incorporate all appropriate comments received from the public into the Final Dissolution Plan. The Village Board is required to adopt the Final Dissolution Plan within 180 days following the close of the last public hearing.top

  1. Will the Village vote on the Dissolution Plan?

No. After the Village Board adopts the Final Dissolution Plan, the Village of Macedon electorates will decide whether the plan as adopted is acceptable. If the plan requires revisions, the electorates will have 45 days to enact a petition calling for a new referendum on the Dissolution Plan. The referendum must be held at least 60 but no more than 90 days after the enactment of the resolution calling for the referendum.top

  1. Will the Town of Macedon vote on the Dissolution Plan?

No the Town of Macedon will have no vote in the Village’s dissolution process. This is considered a local government decision. Only the residents of the Village of Macedon were permitted to participate in the referendum for the Village dissolution. Only the residents of the Village of Macedon shall be permitted to petition for a future referendum on the Dissolution Plan.top

  1. Who is selected to the Steering Committee?

The Steering Committee consists of community leaders and residents that are appointed by the Village Mayor and Board of Trustees.top

Check this website periodically for updates. When there is a major step in the process completed, it will be available on this site, in the local newspaper, and posted at the Village Hall.top

  1. What will happen to the current services?

The completed Dissolution Plan will outline various options for services within the proposed Dissolution Plan. The Steering Committee will hold public forums for residents of the Village and Town to comment on the Plan.top

  1. Who leads the Village upon dissolution?

Upon dissolution of the Village, the Town of Macedon becomes the responsible government entity for the former Village residents. The responsibility of the services, assets and liabilities of the former Village will be evaluated as part of the Dissolution Plan and presented to the community through the proposed Dissolution Plan.top
